Terms of Service 

 You agree that when you proceed with your application for login on our website propetylogger.com that a contract will be created between you and us on the terms (the “Terms”) set out below. References to "we", "our" and "us" are references to Property Logger. References to "you" and "your" are references to the individual in respect of whom subscription of the Property  Logger is being applied for. These terms of service ("Terms") cover your use and access to our services, client software and websites ("Services"). Our Privacy Policy explains how we collect and use your information while our ("Acceptable Use Policy") outlines your responsibilities when using our Services. By using our Services, you're agreeing to be bound by these Terms, our Privacy Policy and Acceptable Use Policy. If you're using our Services for an organisation, you're agreeing to these Terms on behalf of that organisation including all terms entered into by that organisation.

1.Services

1.1 We shall, subject to these Terms, provide you with access to our online website to enable you to input information about your property (hereinafter the “Property”) to enable you to log and maintain a comprehensive service history which can be used for your needs to refer. The information that can be logged includes without limitation any text you have updated in our site or any documents you may have uploaded. In respect of work carried out on your property (hereinafter the “Information”)

1.2 Please note that the log entries of Information for the Property in the Property Logger website (hereinafter the “Log Book”) may get transferred when you transfer. Also, that when you sell the Property (or if the property owner dies or becomes insolvent, and where title is then transferred as a result) or you transfer to Property Logger the Log Book for the Property (provided they accept our membership terms and conditions) and the online access to the Log Book by the previous owner shall be restricted. During your period of membership and ownership of the Property you are entitled at any time to print off hard copies of the Log Book for your personal records and for use in connection with the letting and sale of the Property and you can retain these copies after your online access to the Log Book is restricted (when the Property is transferred to a third party or you cease to be a subscriber of our Site). 

1.3 Please note that subject to these Terms and you remaining the owner of the Property, access to the Log Book for the Property (and the related services that come with our subscription )  is provided for as long as you continue your subscription is with us. Your subscription with us may be terminated by you at any time in accordance with Clause 6 below. 

1.4 We may revise these Terms at any time by amending this page. We will notify you of any changes to these Terms by email or writing and/or by posting a notice on the Property Logger website. By continuing to use the Property Logger service after changes to these Terms are made and notified to you, you agree to be bound by such changes.

1.5 We may update our site from time to time, and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, or any content on it, will be free from errors or omissions.


2. Your Content & Your Permissions

2.1 When you use our Services, you provide us with things like your files, content, data, messages, contacts and so on ("Your Content"). Your Content is yours. These Terms don't give us any rights to Your Content except for the limited rights that enable us to offer the Services.

2.2 We need your permission to do things like hosting Your Content, backing it up, and transferring or sharing it when you ask us to. Our Services also provide you with features like photo thumbnails, document previews, easy sorting, editing, sharing and searching. These and other features may require our systems to access, store and scan Your Content. You give us permission to do those things, and this permission extends to our affiliates and trusted third parties we work with.

2.3 Our Services let you share Your Content with others, so please think carefully about what you share. Also, while transferring please ensure that you do not include any personal information or information that you do not wish to be seen or used by others not intended. 

3. Your Obligation to Us

3.1 You're responsible for your conduct. Your Content and you must comply with our Acceptable Use Policy. We may review your conduct and content for compliance with these Terms and our Acceptable Use Policy. With that said, we have no obligation to do so. 

3.2 We are not responsible in any way for the content people post and share/Transfer via the Services.

3.3 Help us keep your Content protected. Safeguard your password to the Services, and keep your account information current. Employ adequate security measure in order to protect your personal log in details from access by 3rd parties and unauthorised use. 

3.4 You acknowledge and warrant that the information provided by you as part of the service is correct and accurate to the best of your knowledge.

3.5 You agree that in using our services you will not knowingly :

   3.5.1  Email , transmit, publish, upload, link to otherwise disseminate any information, data or document(including text, photographs or other images) which is false, misleading, defamatory, libelous, obscene, in breach of any right of confidence, copyright or other intellectual property or other rights, vulgar, or indecent or may have the effect of being harmful to minors or others, harassing, threating, abusive, or hateful or that otherwise degrades or intimidates an individual or group of individual on the basis of religion gender, sexual orientation, race, ethnicity, age or disability or that is illegal or gives rise to any civil liability or which damages our reputation or the reputation of any of our affiliated, partners, sponsors or their affiliates. 

3.5.2 transmit, upload, publish or otherwise disseminate personal data regarding any other person, including without limitation, their email address or other contact details that would enable any third person to contact such person other than using information made publicly available by such person (and if necessary you should take care to blank these personal details out before the relevant information is transmitted, uploaded, published or otherwise disseminated);

3.5.6 transfer, upload, share or otherwise disseminate files that contain viruses, trojans, worms or other harmful programs, code or files; 

3.5.7 use our online Log Book Services in any way that may lead to the encouragement, procurement or carrying out of any criminal activity; or

3.5.8 use our online Log Book Services to impersonate any person, or entity or falsely state or otherwise misrepresent your affiliation with a person or entity, or send unsolicited communication, promotions or adverstisements, or spam;

3.6 You warrant that any such contribution does comply with the above standards, and you will be liable to us and indemnify us for any breach of that warranty.

4. Our Content

The Services are protected by copyright, trademark, and all other relevant Australian and foreign laws. These Terms don't grant you any right, title or interest in the Services, others' content in the Services, trademarks, logos and other brand features. We welcome feedback/suggestions,  but note that we may use comments or suggestions without any obligation to you.

5. Copyright

We respect the intellectual property of others and ask that you do too. We respond to notices of alleged copyright infringement if they comply with the law, and such notices should be reported promptly. We reserve the right to delete or disable content alleged to be infringing and terminate accounts of repeat infringers. 

6.Paid Accounts

6.1 Billing. If you have a free or account, you can continue access to your account and at the end of the free period by paying for a subscription (turning your account into a "Paid Account"). We'll automatically bill you from the date you convert to a Paid Account and on each periodic renewal until cancellation. We may send you a notice email reminding you that your plan is about to renew within a reasonable period of time prior to the renewal date. You're responsible for all applicable taxes, and we'll charge tax when required to do so. 

6.2 You may cancel your Paid Account at any time. Refunds are only issued if required by law. 

6.3 Downgrades. Your Paid Account will remain in effect until it's cancelled or terminated under these Terms. If you don't pay for your Paid Account on time, we reserve the right to suspend it or reduce your storage to free space levels.

6.4 Changes. We may change the fees in effect but will give you advance notice of these changes via a message to the email address associated with your account or will be listed on our website

6.5 Termination

6.5.1 You're free to stop using our Services at any time. We reserve the right to suspend or terminate your access to the Services with notice to you if:

(i) you're in breach of these Terms,

(ii) you're using the Services in a manner that would cause a real risk of harm or loss to us or other users, or

(iii) you don't have a Paid Account and haven't accessed our Services for 12 consecutive months (except if you have paid a fee upfront).

6.5.2 We'll provide you with reasonable advance notice via the email address associated with your account to remedy the activity that prompted us to contact you and give you the opportunity to export Your Content from our Services. If after such notice you fail to take the steps we ask of you, we'll terminate or suspend your access to the Services.

6.5.3 We won't provide notice before termination where:

(i) you're in material breach of these Terms,

(ii) doing so would cause us legal liability or compromise our ability to provide the Services to our other users, or

(iii) we're prohibited from doing so by law.

6.5.4 Any termination of your membership pursuant to this Clause 6 shall be without prejudice to any other rights or remedies either you or us may be entitled to hereunder or at law and shall not affect any accrued rights or liabilities of either you or us.

6.5.5 Discontinuation of Services

We may decide to discontinue the Services in response to unforeseen circumstances beyond our  control or to comply with a legal requirement or any natural or man-made disaster. If we do so, we'll try to give you reasonable prior notice so that you can export Your Content from our systems else we also recommend you keep a back up of the important details locally in your system. If we discontinue Services in a planned way before the end of any fixed or minimum term under your Paid Account, we'll refund the portion of the fees you have pre-paid but haven't received Services for and also give you notices via email to your account with us. Also, such a refund does not apply if you have paid an upfront fee and received Services.

7. No Verification

7.1 Please note that we do NOT verify or guarantee any of the Information contained in the Log Book against any property. 

7.1 If you are purchasing a property and it already has a Log Book on our website, you should take care to carry out such checks as you see fit to satisfy yourself about the accuracy of the Information for that property. As part of the purchasing process we would also recommend that you require the seller to warrant that the Information contained in the Log Book for that property is true and accurate to the best of the knowledge and belief of the seller. Remember you may be required to do the same when you come to sell the same property in the future.

8 GENERAL 

8.1 Transfer and Sub-Contracting: None of the rights or obligations of either you or us may be transferred, assigned or novated to any other person without the prior written consent of you or us (as applicable) provided always that nothing shall prevent us from delegating the performance of certain functions in whole or in part as otherwise provided in these Terms.
